(1). GENERAL TERMS AND CONDITIONS.
While we at AUSTRALIAN NIGHT VISION may offer guidance to assist a potential purchaser* with the selection of a product, we DO NOT & CAN NOT MAKE, or OFFER, any GUARANTEE as to the SUITABILITY of any product for any proposed use, as individual requirements and situations will vary considerably, therefore AUSTRALIAN NIGHT VISION cannot accept liability of any kind, for the final choice made by the purchaser.
As a controlled item, a GSCI product cannot be returned for refund/credit or other means. (See (2) below).
Therefore, no allowance, financial or otherwise, can be made, or provided, for the return of any item/s should that item/s not perform to the purchaser’s perceived standard, or for any change of mind.
The purchaser must ensure they fully understand the meaning of all the appropriate specifications applicable to their selected item.
Therefore, the purchaser accepts all responsibility for being satisfied that the item chosen is suitable for their own intended purpose, prior to purchase.

All night vision and thermal imaging equipment sold by AUSTRALIAN NIGHT VISION, is warranted by the manufacturer/s to perform to the specifications stated, and against faults for the indicated period, under the terms and conditions set out by the manufacturer.
Full payment is required before delivery unless otherwise specifically agreed to.
(Govt. purchases on official order excepted)
Payment is non-refundable and no allowance made, financial or otherwise, unless that requested item is no longer available.
In that case a refund or alternative item may be selected by the purchaser.
AUSTRALIAN NIGHT VISION staff will always assist a purchaser with any query or question they may have in relation to the performance of their selection.
Note, due to no authorized service capabilities being available in Australia, it will require the items to be returned to the manufacturer for repairs under the terms and conditions set out by the manufacturer.

(2). IMPORTED “CONTROLLED” ITEMS.
GENERAL STARLIGHT COMPANY INCORPORATED (GSCI) equipment is imported on a CANADIAN GOVERNMENT EXPORT CERTIFICATE as a controlled item, and once a request to purchase has been accepted by AUSTRALIAN NIGHT VISION and the order is placed with GSCI, it is then binding and cannot be varied or altered under GSCI terms & conditions of sale unless specifically authorized.
Pricing is shown in $US on this site, and the current $Au will apply at the time of money transfer to Canada. Australian GST will be added, calculated on the day on clearing Australian Customs.
Variations of price can occur rapidly due to the US/Au dollar value fluctuations, the final price will be adjusted accordingly, prior to delivery.
Where, if with prior agreement, a deposit or part payment only, is paid to AUSTRALIAN NIGHT VISION/AUSTRALIAN SHOOTING SERVICES for any item/s, the "purchaser" named on the invoice shall forfeit that deposit or part payment should the "purchaser" fail to complete the invoiced sale within 30 days of notification, for any reason whatsoever.
The "purchaser" will then also be liable for all additional associated costs incurred by AUSTRALIAN NIGHT VISION/AUSTRALIAN SHOOTING SERVICES, including, but not limited to, freight and insurance of that item to Australia, Australian Goods and Services Tax, Customs brokerage costs.

STATEMENT OF ACCEPTANCE OF CONTROLLED ITEMS.
Upon full payment of an invoice, the PURCHASER named on the invoice, has then accepted ownership of the device/s and certifies that the device/s stated on the invoice, is/are for use solely within Australia by that purchaser, and will not be re-exported without prior approval from the Australian Department of Defence Export Control (DEC) & Australian Customs (Border Force), and further certifies that the device/s will not be used for military purposes, nuclear or missile proliferation or in the design of these weapons of any kind, and will not be resold to any entity involved in such activity.
The device/s will not be copied or modernized without written consent from the GOVERNMENT of CANADA.

Once the item/s has been shipped from Australian Night Vision to the purchaser, at that point, the purchaser therefor accepts full responsibility for that item/s.
The current purchaser (Owner), if intending to offer for resale, export, or transfer by any other means, must ensure they obtain written documentation or notification of the resale, export, or transfer by any other means, of ownership of those item/s from the intended purchaser/receiver.
NOTE. If it is intended to export the product for any reason, a permit from Defence Export Control and a permit from Border Force (Australian Customs) MUST be obtained beforehand.
Australian Night Vision, a division of Australian Shooting Services, being the distributor for the GENERAL STARLIGHT COMPANY INCORPORATED, will, for any warranty claim on a GSCI product, obtain the required AUSTRALIAN GOVERNMENT EXPORT PERMITS at no cost to the purchaser, but the purchaser will be liable for the cost of freight and insurance under the terms and conditions of the Canadian Warranty, unless it has been specifically agreed to in writing to be otherwise, by the General Starlight Company Inc. of Canada.

(3). A PURCHASERS UNDERSTANDING.
A purchaser*, is deemed to be the person/organization named on the invoice, and/or includes any person who places an order on behalf of the purchaser, whether authorized to do so or not, will also be held responsible for that purchase.
As Australian Night Vision can only offer guidance to a purchaser, we therefore cannot and do not guarantee suitability of the product.
A purchaser must assure themselves that their choice of product will fulfil their own requirements BEFORE purchase, as those requirements vary greatly from user to user.
The purchaser must also be fully aware of the fact that all classes of IMAGE INTENSIFYING, THERMAL IMAGING & DIGITAL devices, performance WILL vary considerably under differing atmospheric conditions, and does NOT constitute faulty equipment.
Regardless of claims made by some, stating that thermal imaging is not affected by smoke, fog, rain etc., it is important to be aware that all of those situations will affect the performance of all grades of thermal imaging by varying degrees, dependent on the prevailing conditions. As it will with all other types of night vision products.
Humidity, even atmospheric pressure will alter the performance to some extent.
It is claimed at times by various sources, that thermal imaging will “see through thick bushes etc., unlike other forms of night vision".
Anything that completely shields an object/target or any part thereof, will prevent it, or that part, being seen with all optical devices.

It is important to be aware that delivery times are estimated only, due to unforeseen situations in the time taken to obtain the Canadian Government Export Permits and international freight times, as well as most items are produced "to order" to suit specific customer requirements.
It should be understood that all products on this site will need to be returned to the manufacturer for repair during, and/or after the warranty period has expired and therefore may entail delays in servicing of products from the service centre.
The purchaser should be aware they will be liable for the cost of freight and insurance to the manufacturer as per their (GSCI) warranty statement, as well as for any non-warranty repairs.
It is therefore understood by all parties that -
THE PURCHASER HAS AGREED TO THESE TERMS AND CONDITIONS PRIOR TO MAKING A PURCHASE.
